Terms of Service
These Terms of Service govern the septic-related services provided by J Sweat Septic to customers throughout Northeast Florida.
1. Agreement to Terms
These Terms of Service (“Terms”) govern the services provided by J Sweat Septic (“Company,” “we,” “us,” or “our”) to residential, commercial, municipal, builder, contractor, property management, and other customers (“Customer,” “you,” or “your”). By requesting, approving, scheduling, or paying for services from J Sweat Septic, you agree to these Terms.
2. Services Provided
J Sweat Septic may provide septic-related services, which may include, but are not limited to:
- Septic tank pumping
- Septic inspections
- Septic system troubleshooting
- Drain field evaluation or service
- Septic repairs
- Septic system installation support
- Maintenance services
- Emergency or priority septic service calls
- Site evaluations, recommendations, and related septic support
The exact services to be performed will be based on the estimate, invoice, written proposal, work order, service agreement, or other written communication provided by J Sweat Septic.
3. Estimates, Quotes, and Proposals
Estimates, quotes, and proposals are based on the information available at the time they are prepared. Unless otherwise stated in writing, estimates are not guaranteed final prices.
Final pricing may change due to factors including, but not limited to:
- Unknown underground conditions
- Tank depth, condition, location, or accessibility
- Drain field condition
- Groundwater or soil conditions
- Blockages, backups, collapsed lines, or damaged components
- Required permits, inspections, engineering, or third-party services
- Additional labor, materials, equipment, disposal, or travel needs
- Customer-requested changes to the scope of work
If additional work is needed, J Sweat Septic will make reasonable efforts to notify the Customer and obtain approval before proceeding, unless the work is necessary to prevent property damage, protect health or safety, comply with applicable requirements, or complete work already authorized.
4. Customer Approval
A Customer may approve work verbally, in writing, by email, by text message, by signing a proposal or invoice, by paying a deposit, or by allowing J Sweat Septic to begin work.
Once approved, the Customer is responsible for all approved charges, including labor, materials, equipment, disposal fees, permit-related fees, emergency fees, and any other approved or necessary costs associated with the work.
5. Scheduling and Access
Service dates and times are estimates and may be affected by weather, traffic, equipment availability, emergency calls, permitting, inspection scheduling, site conditions, or delays outside of J Sweat Septic’s control.
The Customer is responsible for providing safe and reasonable access to the service location, septic tank, drain field, cleanouts, utility areas, and any other areas required to perform the work.
If J Sweat Septic cannot access the necessary work area due to locked gates, pets, vehicles, landscaping, structures, buried lids, unsafe conditions, or other obstructions, additional charges may apply for delays, return trips, excavation, or rescheduling.
6. Customer Responsibilities
The Customer is responsible for:
- Providing accurate property and contact information
- Identifying known septic system locations, tank lids, cleanouts, drain fields, and prior repairs
- Informing J Sweat Septic of known hazards, utilities, irrigation, electrical lines, private lines, wells, buried tanks, or other underground features
- Obtaining owner, tenant, HOA, landlord, or property manager authorization when required
- Providing safe access to the work area
- Keeping children, pets, tenants, visitors, and unauthorized persons away from the work area
- Removing vehicles, objects, landscaping items, fencing, or obstructions when needed
- Paying all amounts due according to the invoice or agreement
J Sweat Septic is not responsible for delays, added costs, or damages resulting from inaccurate, incomplete, or withheld information from the Customer or third parties.
7. Utilities, Underground Lines, and Site Conditions
Septic work may involve digging, pumping, excavation, heavy equipment, or access to underground components. The Customer is responsible for identifying and disclosing the location of private utilities and underground items that may not be marked by public utility locating services, including but not limited to:
- Irrigation lines
- Landscape lighting
- Invisible pet fencing
- Private electrical lines
- Pool lines
- Water lines
- Gas lines
- Drainage pipes
- Internet, cable, or communication lines
- Wells, pumps, or private utility systems
J Sweat Septic will use reasonable care when performing work. However, unless caused by gross negligence or willful misconduct, J Sweat Septic is not responsible for damage to unmarked, improperly marked, hidden, privately installed, deteriorated, or unknown underground items.
8. Permits, Inspections, and Government Requirements
Some septic work may require permits, inspections, approvals, engineering, soil evaluations, or other government or third-party requirements. Requirements may vary by county, municipality, property type, system type, and scope of work.
Unless otherwise stated in writing, permit fees, inspection fees, engineering fees, county or state fees, and other third-party fees are the responsibility of the Customer and may be billed in addition to labor and materials.
J Sweat Septic may assist with permit-related coordination when applicable, but approval timelines, inspection results, agency requirements, and permitting decisions are outside of J Sweat Septic’s control.
The Customer understands that work may be delayed, modified, or stopped if required approvals are not obtained or if site conditions do not meet applicable requirements.
9. Unknown or Concealed Conditions
Septic systems are often underground, aged, undocumented, modified, or affected by prior work. Unknown conditions may not be discoverable until work begins.
Examples of unknown or concealed conditions include, but are not limited to:
- Buried or inaccessible tank lids
- Damaged, cracked, collapsed, or deteriorated tanks
- Unrecorded system modifications
- Saturated soil or high groundwater
- Failed drain fields
- Root intrusion
- Grease buildup or foreign objects
- Improper prior installation or repair
- Unsafe or unstable soil
- Structural obstructions
- Undisclosed utility conflicts
If unknown or concealed conditions are discovered, additional charges may apply. J Sweat Septic may recommend changes to the scope of work, repairs, replacement, engineering, inspection, or other corrective measures.
10. Septic Pumping and Cleaning Services
Septic pumping services generally include pumping accessible septic tank contents according to the agreed service scope.
Unless specifically included in writing, septic pumping does not include:
- Locating a tank
- Digging to uncover buried lids
- Repairing broken lids, baffles, lines, pumps, alarms, or electrical components
- Clearing blockages beyond the tank
- Drain field repair or replacement
- Camera inspections
- Hydro-jetting
- Permit-related work
- Long-distance hose runs or difficult-access service
- Disposal of non-standard waste or prohibited materials
Additional charges may apply if the tank is difficult to access, deeper than expected, contains excessive solids, contains prohibited materials, requires additional labor, or requires special disposal.
Pumping a septic tank does not guarantee that the septic system will function properly after service, especially if there are drain field issues, line blockages, damaged components, improper use, groundwater problems, or system failure.
11. Repairs, Installations, and Replacement Work
Repair, installation, and replacement work will be performed according to the agreed scope, applicable requirements, site conditions, and available materials.
J Sweat Septic is not responsible for pre-existing defects, improper prior work, system age, undocumented system changes, soil limitations, groundwater conditions, or failures unrelated to the specific work performed by J Sweat Septic.
Any changes to the approved scope may require a written change order, revised estimate, additional payment, or schedule adjustment.
12. Emergency or Priority Service
Emergency, after-hours, weekend, holiday, or priority service may be subject to additional fees. Availability is not guaranteed.
J Sweat Septic will make reasonable efforts to respond promptly, but response times may vary based on location, weather, demand, equipment availability, site conditions, and other scheduled or emergency work.
13. Payment Terms
Payment terms will be stated on the estimate, invoice, proposal, or work order. Unless otherwise agreed in writing, payment is due upon completion of the service or upon receipt of the invoice.
J Sweat Septic may require a deposit before scheduling or beginning certain work, including repairs, installations, replacement work, special-order materials, emergency service, or larger projects.
Accepted payment methods may include cash, check, electronic payment, card payment, or other approved payment methods. Returned checks, failed payments, chargebacks, or unpaid balances may result in additional fees.
Past-due balances may be subject to late fees, collection costs, attorney’s fees, court costs, lien rights where available by law, and suspension of future service.
14. Cancellations and Rescheduling
The Customer should notify J Sweat Septic as soon as possible if a scheduled service must be canceled or rescheduled.
Cancellation, missed appointment, or rescheduling fees may apply if:
- J Sweat Septic has already dispatched personnel or equipment
- Materials have been ordered
- Permits or inspections have been scheduled
- The Customer fails to provide access
- The work area is not ready
- The Customer cancels after work has begun
Deposits may be non-refundable to the extent they cover administrative time, permitting, scheduling, mobilization, materials, special orders, or other costs already incurred.
15. Property Disturbance and Restoration
Septic work may require digging, driving equipment onto the property, removing soil, accessing landscaped areas, or disturbing grass, sod, mulch, gravel, concrete, pavers, fencing, irrigation, or other property features.
Unless specifically included in writing, J Sweat Septic is not responsible for restoring landscaping, sod, grass, mulch, plants, trees, concrete, asphalt, pavers, driveways, fences, decorative features, irrigation, or other property improvements after septic work.
J Sweat Septic will use reasonable care, but the Customer understands that some disturbance may be unavoidable when performing septic work.
16. Warranties
J Sweat Septic warrants that services will be performed in a workmanlike manner according to the agreed scope of work.
Any workmanship warranty, material warranty, manufacturer warranty, or system warranty must be stated in writing to apply. Warranty coverage does not apply to:
- Misuse, abuse, neglect, or improper maintenance
- Excess water usage
- Flushing prohibited items
- Grease, chemicals, wipes, feminine products, diapers, paper towels, or foreign objects
- Damage caused by vehicles, heavy loads, landscaping, construction, roots, groundwater, flooding, storms, erosion, or third parties
- Existing system failure or pre-existing conditions
- Normal wear and tear
- Work performed or modified by others
- Failure to follow care instructions or maintenance recommendations
No warranty guarantees that an existing septic system will continue to function, that backups will not occur, or that future repairs will not be needed.
17. Septic System Use and Maintenance
The Customer is responsible for proper septic system use and maintenance after service is completed. J Sweat Septic may provide recommendations, but ongoing system performance depends on many factors outside of J Sweat Septic’s control, including water usage, household size, soil conditions, system age, system design, maintenance history, and items introduced into the system.
The Customer should avoid flushing or draining items that may harm the septic system, including wipes, grease, chemicals, feminine hygiene products, paper towels, diapers, paint, solvents, medications, and other non-septic-safe materials.
18. Unsafe or Unsanitary Conditions
J Sweat Septic may refuse, pause, or stop work if conditions are unsafe, unsanitary, unlawful, inaccessible, or materially different from what was represented.
Unsafe conditions may include, but are not limited to:
- Aggressive animals
- Unsafe access areas
- Unstable soil or structures
- Hazardous materials
- Electrical hazards
- Flooding or severe weather
- Sewage exposure risks
- Threatening behavior
- Lack of proper authorization
If work is paused or stopped due to unsafe or unsanitary conditions, the Customer remains responsible for work performed and costs incurred up to that point
